Peter's Areas of Practice

COUNSELING
Peter provides legal counsel in all areas of environmental, natural resources and land use law. Counseling work includes researching specific legal issues in these subject areas and providing an oral briefing or a legal memo or letter. Other examples of such legal work include helping a client perform a site investigation and cleanup of contaminated real estate or a facility, and serving as common counsel for a group of liable parties at a state or federal Superfund site. MTCA and federal Superfund work usually involves contracting with consultants and remediation contractors and negotiating agreements with regulators and third parties.

LITIGATION

This work includes defending clients in regulator enforcement actions, prosecuting and defending clients in state and federal Superfund cost recovery actions, permit appeals before hearings boards, environmental insurance coverage claims, condemnation and commercial litigation.

 
DRAFTING ENVIRONMENTAL AGREEMENTS
Peter assists clients purchasing, selling or developing contaminated properties by drafting environmental provisions and agreements in real estate transactions to protect the client and shift liability to the other party. This transactional work may also include counseling advice concerning environmental due diligence, insurance, form of agreement and whether to seek cost recovery after cleanup.
 
PERMITTING
Peter assists public and private clents in obtaining and defending all necessary permits and approvals to operate their municipality or business and develop their properties. Permits and approvals may be required by local ordinances and the following statutes: the Clean Water Act, Clean Air Act, RCRA, SEPA and NEPA, Shoreline Management Act, and Growth Management Act. In Washington State, both at the local and state levels, climate change provisions are being integrated into the SEPA and Growth Management Act processes.
